Tacky, I know, but I need some advice, or send me somewhere I can get it.
Here's the thing, still legally married but want to file separately and claim one of my kids.
Is there any reason I can't do this?
Trying to get a refund this year and set the precedent of claiming one of my kids.
I know it's a general forum but I really need to kow this before deciding to go with an accountant or tax preparer.
We still live in the same house, both parents, both kids.
Thanks.

Mrhtbd,
I have done this prior back in 99 ' you will get raped if you file Married filing seperate even claiming 1 child .....I dont advise you going that route,
Wouldnt be easier to just file married filing jointly ,claim both kids and split the refund 50/50?
The IRS will ravage you for filing seperate but it is an option and you can pursue it ,I have done it as I mentioned , My first wife and I were going through a divorce ,still married at tax time but filed seperate ,,,,Ouch ,,,,,,
I got an idea for you , Go to Turbo Tax and do your taxes both ways , try it married filing jointly and married fileing seperate . It will allow you to do it both ways and see your anticipated refund amount ,make your decision and then go for it .

She always gouges me on taxes. I figured out how she does it.
She claims 0 dependents on her W2, while I claim 3. At the end of the year, she owes and I get some back, but not so fast, as she balances the extra I paid in with hers and 3 of the past 4 years I got less than $100 back, and last year we owed $2100, of which I paid half.
So greedy it's ridiculous.

I agree with filing through turbotax. Best way to plug and play with numbers to get the max dollar you can. Send me a pm if you need help, as being in the military there are ways many don't know to get little bit more then what they expected.

I've always been told that turbotax would get you the most money back, but was unsure to try them cos of the IRS audit thing and all.

You are the one causeing you to pay not her. By claiming zero she is paying more tax than you. It's your falut there dude.:lang:

Maybe it's the other way around.
All I know is last year she made $10,000 more than me and I paid $3,000 more in Federal Taxes.

You can claim married and how many ever depend ants you want. Don't recommend showing over six dependents. It does raise a red flag...
