Terrible week, need legal advice.....

ok, to start off.......

friday night i was in a accident and smashed up the front end of my car pretty good. i was going to pick up my little brother from a b-ball game and there was a pizza truck parked with flashers on, on the side of the school. i went to go around the truck and all of a sudden a gold van comes flying up the side and almost nails me dead on...i swerve off to the right no not get killed and i smashed into the back of the pizza truck. the gold van (who was easily speeding) just drove off.....my car was toed away on a flat bed, and today i got a thing in the mail from the district justice.....

it says the cop filed a report and says that i was guilty of pa law code: 3361 (DRIVING AT A SAFE SPEED) and i got a citation stapled to it (totaling $110) and it says i have 10 days to respond with an action about appearing in court or a warrent for my arrest will be issued....what the hell am i supposed to do?
 
AND TO TOP IT ALL OFF......MY GF JUST BROKE UP WITH ME FOR A GOOD FRIEND OF MINE.......

man i'm not sure about the legal advice, but keep your head up. A long time ago when I was like 15 my g/f broke up with me for me little brother haha Luckily my brother told her to shove it but in time u will be able to laugh about it.

O and I wrecked running from the cops before in HS so believe me when I say everything will work out.

keepin my head up is all i can do......and lifting is all i got left right now....so ill be focusing all my attention on that.....but i really could use some legal advice...
 
doesn't make sence...why do you have to appear in court? Are you being sued? Where you speeding, or did he put you down as speeding?
 
Usually with a ticket you have the option of either paying the fine (which admits that you are guilty of the charge) or fighting it in hopes that they drop the charge/fines. If you choose to fight the ticket all you really need to do is go in to court, plead "not guilty", then explain your situation to the judge. The judge will decide if you deserve the fine or not. Best case scenario - the officer doesn't show up and it is dropped without you even having to say anything. Worst case scenario you waste an hour of your time and still have to pay the fine. I would go in and take the gamble... you might just get the judge to drop or lower the penalty.

SOrry to hear about your girl, that just sucks.
 
Actually it should be driving at an unsafe speed, not safe speed..attest the ticket and resond.....tell them you want a court appearance....then email me at [email protected]..

most can attest here that I know something about the law...LOL..

this is the law:

? 3361. Driving vehicle at safe speed.

No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing, nor at a speed greater than will permit the driver to bring his vehicle to a stop within the assured clear distance ahead. Consistent with the foregoing, every person shall drive at a safe and appropriate speed when approaching and crossing an intersection or railroad grade crossing, when approaching and going around a curve, when approaching a hill crest, when traveling upon any narrow or winding roadway and when special hazards exist with respect to pedestrians or other traffic or by reason of weather or highway conditions.
 
if i was to pay the $50 collateral to go to court and contest this, would i get it back when i showed up? would there be any court costs?
 
If you have the option of paying the fine OR appearing in court to contest this....PAY THE FINE!

I have had dozens of tickets and been to court many many times. Every case is different, but the one thing that never changes is this. In traffic court, unless you are defending yourself on something as serious as a manslaughter charge, you will never get a judge to set aside a ticket from a policeman. A lawyer is an absolute waste of time and money. I would never even plead "No contest." Seems like a good idea....but I can tell you from personal experience that traffic court judges look upon anything other than "I'm guilty...I won't let it happen again" as a confrontation. You won't ever get off not guilty or with a reduced fine....but according to how the judge feels that day, you may get even more.

If your insurance rates will go through the roof, it might be worth the time to appear in court. But all you will almost suredly get the same fine as is on your ticket...plus $50 in court costs and a day wasted in court. I have NEVER seen a lawyer be of ANY help in any traffic court scenario.
 
Check with your local LE, but I don't think if it's an offence that could result in a lost licence, you could even pay it out of court. Justy call the court house and ask if it's serious enough to result in a lost licence. Here in Ohio, it takes 10 points to lose a licence. A traffic fender bender is 2 points.

LE=law enforcement. Call your sheriff's office or court house, that'a all.
 
you wont lose your license...what I was getting out was you had an unsafe speed...worded different vs Cali...Cal vehicle code 22350.....anyway....as I said above get your court date...and we can work on getting your defense...not sure how the cop can attest to unsafe speed....many variables involved including, traffic, weather, conditions, pedestrian and motor traffic, area, construction, posted speed limits, surveys by the city for that given street...
